How many days do you have to transfer a title in South Dakota?

You have 45 days from the date of purchase to title and register the car. There are no extensions. The seller also has 45 days to hand over the title.

On a private sale, the seller gives you a free seller's permit, good for 45 days, so you can drive the car until you title it.

What are the late fees for a title transfer in South Dakota?

South Dakota has three separate late charges:

  1. Late title fee: $1 for each week past day 45, up to a maximum of $50. Applying more than 90 days late is also a Class 2 misdemeanor.
  2. Interest on the excise tax: charged on applications after 45 days, with at least $5 for the first month. The Department of Revenue's own pages give two different monthly rates: 1% on its All Vehicles page and FAQs, and 1¼% on its Cars, Trucks & Vans page.
  3. Penalty after 60 days: a one-time 10% of the tax or $10, whichever is more.

All of these count from the purchase date, whenever you apply.

South Dakota excise tax on a car: 4%

South Dakota charges a 4% motor vehicle excise tax instead of sales tax. You pay it to the county treasurer when you title.

Family sales and gifts

These transfers are free of the excise tax:

A family sale for money is taxed at 4%. A gift to anyone outside the list (a friend, cousin, aunt or uncle) is also taxed, on the car's book value. The $10 title fee still applies to exempt transfers.

Registration fees and wheel tax

Registration is set by the car's shipping weight:

Shipping weightPer year
Up to 2,000 lbs$36
2,001 to 4,000 lbs$72
4,001 to 6,000 lbs$108
Over 6,000 lbs$144

Cars 10 or more years old pay 70% of these amounts. Each registration also carries a $1 solid waste fee, a $1 Highway Patrol fee and the $2 technology fee.

County wheel tax: counties may add up to $5 per wheel, with a maximum per vehicle set by the county. Minnehaha County charges $4 a wheel, up to $60. Five counties charge nothing: Harding, Hyde, Jones, McPherson and Oglala Lakota. The Department of Revenue's county wheel tax table lists every county.

Plates

South Dakota plates stay with the owner. When you sell, you keep your plates. When you buy another car, you move them to it at the county treasurer's office. Reassigning them costs $5.
